The USR attacked at Constitutional Court "Law on the swearing-in of teaching staff teaching, driving, guidance and control with the exercise of during and in connection with the performance of their duties of service", initiated by PSD senator Şerban Nicolae.According to the law, "aggressors" of teachers risk more than one third more than in in the event of physical or verbal violence.

If at present the one who threatens a teacher can receive up to one year in prison under the new law the penalty reaches one year and four months, according to the document. In its referral, the USR made a whole series of arguments, both as regards the way in which it was adopted and the content. For example, by amending the punishment regime and enforcement, the law would have been constitutional only if no amendments to the bill had been made during the debates in the Senate, which was not the case. By adopting the amendments proposed by PSD Senator Liviu Pop, the law should have been returned to the Chamber of Deputies and re-adopted there. Beyond formal aspects, the USR considers that the law contains several provisions imprecise, which leaves the place at interpretations and abuses on the part of the teacher, turning him into a 'investigating agent' of a crime. More than that, the law is discriminatory, for under Art. 4, it is considered that in where there is a disputeable situation, 'the facts supported by the teacher enjoys relative presumption of veracity", which means that "The teacher is always right." Vlad Alexandrescu, USR senator and university professor, says: "We cannot accept that the teacher is a militiaman who forcibly imposes his opinion in school. The school is about education, not about training, and the respect that the initiators of the law claim to impose in this way are not obtained, in fact, either by force or fear. The educational process involves living interaction between teacher and student, partnership and constant exchange of information on both sides. We cannot turn the student into a passive element of the educational process. In the latest analysis, the student may be prohibited from asking legitimate questions if they are deemed "offensive" by the teacher. She leads the Romanian school back 200 years. Last but not least, in the spirit of the adopted law, the student or parent no longer enjoys the 'presumption of innocence', they have to prove his 'innocence', which is contrary to the principles of national and European law. This law is a force of balance between students-parents on the aside and teachers on the other hand in the educational act and the transformation of the teacher into a investigating agent." We believe that we are all equal before the law, the legislature has no right to create a species of citizens privileged before the law. The referral was signed by all 13 USR senators and 12 NLP senators.
